The Attorney-General notes, with deep concern, the fact that, the purported findings of a judicial inquiry held before the District Court of Moka, have found their way in the public domain. The judicial inquiry was heard by the District Magistrate of Moka upon a referral by the Director of Public Prosecutions (DPP).

In accordance with the provisions of the District and Intermediate Courts (Criminal Jurisdiction) Act, the Magistrate is enjoined to report her findings to the DPP.. Such a report is invariably transmitted to the DPP under the seal of the relevant District Court.

On Friday 14 October 2022, the purported report of the District Magistrate of Moka was aired in the public domain on Téléplus. The purported report as published, is unsigned and does not appear to bear the official seal of the District Court.

Given the seriousness of this matter, the Commissioner of Police will be advised to initiate an enquiry to the full extent of the law, including whether a potential offence of conspiracy to do an act wrongful to another person is warranted.

Notwithstanding the above, it is open to other interested parties, to seek appropriate remedy against the purported findings of the District Magistrate of Moka if they so wish.

Given the grave circumstances, the Attorney-General will also have consultations with the Honourable Chief Justice to address the issue of whether the Judicial and Legal Service Commission ought to take such action as appropriate, in the event that officers within its purview have maintained the highest ethical and professional conduct or not.
